Terms & Conditions Upfront Introductions is the provider of the upfrontintroductions.com service (the “Service”) and the upfrontintroductions.com website (the “Site”). Your (“you”) access and use of the Site is subject to compliance with these Terms & Conditions. By accessing or using the Site you agree to be legally bound by these terms and conditions as they may be modified and posted from time to time. The site provides the facility for meeting prospective partners or friends. Upfront Introductions reserves the absolute rights to alter suspend or discontinue any aspect of the Site including your access to it without notice, in the event any modifications may be required for the improvements of the Site. To use the Site you may register by completing the confidential registration form. Subject to validation of the details and the sole discretion of Upfront Introductions you will be granted access the relevant sections of the Site. These terms and conditions solely govern your use of the Site and by registering you warrant and represent that you can form binding contracts under applicable law. The information that you provide to the Site in any form must be true and accurate. In view of the fact that the particulars passed on by Upfront Introductions are based on those given by the clients, we cannot accept any responsibility for possible incorrectness or results. Any user reported to or found to be causing a nuisance or harassing other users, or misusing the Site will at the sole discretion of Upfront Introductions, have their membership terminated without notice. The registered member is solely responsible in all respects for all use of and protecting the confidentiality of any communications between you and other members of Upfront Introductions. You must not share registration details with anyone else including those within your family or friendship circle. Any breach of security or confidentiality must immediately be reported to Upfront Introductions. The service shall be provided in “whole” on a SECURE SITE to ensure maximum levels of security and confidentiality. All communications between the registered users will remain on the SECURE SERVER until one or both members disclose and utilise original email addresses not generated by the Upfront Introductions mail system. Upfront Introductions cannot accept responsibility for the breakdown or failure of any servers at any time, but will take all necessary action to ensure the service continues to operate with the maximum possible security at all times. Registration fees will be charged upon registration at the rate shown for the chosen service. All fees are shown are in pound sterling, and we will charge users registering from abroad in pound sterling too. Refunds cannot be made once the user has accessed the site, and can only be made if requested within 24 hours of registration. Upfront Introductions retains sole ownership of all right, title and interest in and of the Site including all Upfront Introductions generated content however expressed. Upfront Introductions will endeavour to make the Site available at all times but cannot and will not be held responsible for interruptions or any losses, actual or potential, arising from such interruptions whether or not they are under the control of Upfront Introductions. Upfront Introductions reserves the right to close or suspend its facilities at any time at its discretion.> Upfront Introductions does not guarantee that communications in any form will be processed and does not accept any liability for any direct of indirect loss so caused. The service may be cancelled or suspended because of technical difficulties experienced by Upfront Introductions or for other reasons which may be disclosed at the sole discretion of Upfront Introductions. Upfront Introductions will not be liable to you or any third party for any indirect or consequential loss or damage, or for any data, profit, revenue, business, penalties, actions, expenses or disbursements of any kind of nature whatsoever with respect to a) any third party claim b) any breach of these terms and conditions by you c) any third party claim or allegation brought against Upfront Introductions arising out of or relating to a dispute between you and any other party. You agree to indemnify Upfront Introductions and the Site against all losses, liabilities, claims and expenses suffered by Upfront Introductions due to you or your use of the Site. Upfront Introductions or its staff, partners, directors, subcontractors shall not be liable for any loss, injury, claim, liability, or damage arising out of or in any way relating to a) any errors or omissions on or in the Site, b) any third party web sites or contents therein directly or indirectly accessed through the Site, including but not limited to any errors or omissions there from c) the unavailability of the Site or any part thereof, d) your use of the Site, e) the content of the site or f) any delay or failure in the Site performance. Without prejudice to the above the liability of Upfront Introductions will not exceed whether arsing from negligence or otherwise, any amount equal to the fees payable by you to us in relation to the item to which such liability relates. You may not assign your rights or delegate your duties or obligations under these terms and conditions. These terms and conditions contain the entire agreement between you and Upfront Introductions relating to their subject matter and supersede any and all prior agreements and non-fraudulent representations. English law governs these terms and conditions and your use of the Site and you submit exclusive jurisdiction of the English court. If any provision of this agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be enforced to the maximum extent permissible so as to affect the entent of this agreement, and the remainder of this agreement shall continue in full force and agreement. The failure by either you or Upfront Introductions to exercise or enforce any rights or provisions of this agreement shall not constitute a waiver of such rights or provisions. All users of the site are independent contractors and no agency, partnership, joint venture, employee-employe r or franchiser-franchisee relationship is intended or created by this agreement.
